Dear Homeowners,

We are writing to update you on the transition of the Kendall Lane HOA from developer control to homeowner control.

Although trustees were elected at the June 28th annual meeting, Brian Kelleher and Randall Lily remain the sole legal trustees of the HOA. Helmis Circle, the developer, still owns the Kendall Lane roadway and two common lots. As long as Helmis Circle owns any property here, Brian and Randall remain the official trustees.

The trustees you elected are working with our attorney to secure the formal transfer of control. Brian has agreed to have his attorney meet with ours to outline the process. While Brian has indicated the transfer may occur within a few weeks, our attorney believes it will likely take longer.

Unresolved construction and warranty issues may be addressed as part of this process. If you have any outstanding concerns, please inform the elected trustees so they can be included.

Brian also retains control of the HOA bank accounts. While the June 28th meeting was presented as a transfer to homeowner control, that was not the case. A formal handover will take place at a future date that has not yet been set.
